What to Do if a Company Asks for Your Facebook Password - Work It Daily
What to Do if a Company Asks for Your Facebook Password - Work It Daily Imagine youâve been on the job market for about six months. You are paying your mortgage on your credit cards at this point. Your unemployment benefits are about to run out and your job prospects remain dismal, no matter what you seem to do. Finally, you land a killer opportunity, pass the phone screen, and show up to an interview with a hiring manager. Just as you think youâre about to close the deal, she spins her computer screen around and asks you to login to your Facebook account. What do you do? This is common enough it now has a name: Shoulder Surfing. According to Lori Andrews, a law professor at IIT Chicago-Kent College of Law specializing in Internet privacy, this practice is âcoercion if you need a job.â Not to mention the violation in Facebookâs privacy policy, albeit unenforceable. Facebookâs official statement is that shoulder surfing âundermines the privacy expectations and the security of both the user and the userâs friendsâ and âpotentially exposes the employer who seeks this access to unanticipated legal liability.â The ruling, made by the FTC in May, 2011, was that companies can use social media information as part of a background check, but this information must be available from public databases. In other words, strictly speaking, it could be illegal for companies to use private social media information against you without your consent. (I say could be because I am not a lawyer, I just pay attention.) However, there are some cases wherein this type of deep probing could be deemed appropriate; for example law enforcement or defense. In this case, it would be easy for the employer to defend their request to access private data as it pertains directly to the candidateâs qualification to perform the job. But when Justin Bassett, a statistician based in New York, was asked for his Facebook password he refused. And so should you. Many states are already in the process of introducing legislation against this practice, and if you live in Illinois and or Maryland, such legislation already exists. How to Protect Your Privacy in a Job Search As our economy makes its baby steps towards recovery, chances are that fewer people will âneedâ to find a job that desperately. Assuming your situation is not dire (and itâs probably not, the unemployment rate for people with bachelorâs degrees or higher is only around 4.5%), here are some responses you can memorize and use in an interview just in case they ask. I take my agreements very seriously. And it is against Facebookâs user policy to share my password with anyone else. Iâm going to have to respectfully decline your request. Iâm sure your firm has a social media policy. Well, it is my own social media policy to use Facebook for personal reasons. I mean no offense, but Iâm going to have to decline. Privacy is a very serious matter for me. Should I be employed with your organization, I would honor private company information just as seriously as I honor my own. Even if this means losing a great opportunity for me, I must refuse your request. And know that if I were presented with a similar situation with your private information, I would respond in the same way. I wouldnât want to jeopardize your organizationâs standing with OFCCPâs regulations about asking about kids or other protected private matters in the course of an employment decision. Therefore, if you donât mind, Iâd prefer to keep my Facebook profile private. However, should you and I become friendly after my employment, I would have no problem having you in my network. (Note: please see my post on how to deal with nosy bosses on Facebook) I will leave you with one final thought. Never forget that Facebook owns your data no matter what â" and it takes up to seven days for them to remove deleted information from their database. When you use social media you are a publisher. Never forget that. When people complain that they now have to âwatch their stepâ with every post, welcome to reality. Thatâs the way it always was. And I think these issues are arising precisely because we are all maturing in our use and our understanding of social media. How to Counter Offer Your Employees Offer - Spark Hire
How to Counter Offer Your Employees Offer - Spark HireIn todays job market, employees can come and go as fast as the seasons change. Its no longer common for an employee to devote their entire career life to just one company. So say one of your star employees has decided to inform you of their resignation and lets you know that they will be leaving for another company. The reality of the situation sets in and you realize how much of a pain it will be to try and hire a new employee. You want to make your star employee a counter offer, but not so sure of how to do it. Listen up then, because Spark News has got your back. While this next sentence may crush all hopes you had of receiving how to make a counter offer steps, you need to pay attention. Making a counter offer to an employee that has already decided to leave is a bad, bad idea. No matter how difficult hiring a new employee may be, even with savvy online video interviews, its never a good idea to coax an employee that has alread y checked out to stay. Why? Take a look at these great and true reasons why you shouldnt counter offer your employee below. Its Likely Just a Band-AidIf your employee has already taken the time to search for a job, interview with another employer and accept a job offer, then they likely have many reasons as to why. If they were a star employee, and knew it, then they have probably already addressed the issues they have with you or the ort directly. A good employee will bring up big issues or difficulties they have instead of pretending they dont exist. If they did this already and still felt the need to leave the company, then making a counter offer will only serve as a temporary fix. Perhaps you offer them more compensation or added benefits and they accept. Just because they are now paid more doesnt mean that the issues have disappeared. Its likely that this employee will still leave in the next six months anyways, and you will have to hire someone new after all.In the mean time, y ou lost money paying them more and probably lost valuable time as well trying to bend over backwards to accommodate them so they stayed. In the end, it was a waste of time and they decided to leave anyways. Is this really worth it?Lack of CommunicationIf your employees resignation is a complete surprise to you, then you have to question their integrity. Why did they never make light of any issues they were having before? Why didnt they try to figure it out with you before searching for a new job? This points to either a communication issue or a lack of motivation on the part of your employee. If they had truly valued this position they have with you, they would have worked hard to try and smooth out the kinks. Perhaps they were being overworked. Why didnt they ever mention this to you? Unless youre a tyrant that wouldnt listen or try to understand- which is a great reason to leave- they should have communicated with you before they searched for a new job.Questionable Work EthicWere speaking in majorities here, as there will always be exceptions to the rule, but usually when an employee has searched and found another job they have mentally checked out of the one they have with your company. They may accept your counter offer, but how do you know that they will truly be putting their best foot forward from now on? Of course, you can track their work and keep an eye on them, but chances are they have already checked out mentally.Think about it. Why do they call it senior-itis when seniors in high school and college start slacking on their work? Because towards the middle of their last quarter they figure, Im almost done. This doesnt matter Again, not everyone, but once you make up your mind to leave- or decide that you are finished with something- coming back to it with a full-on effort is extremely difficult. Keep this in mind when you think about making a counter offer.Compromised RelationshipThe relationship an employee has with their superior is very importan t- platonically speaking, of course. If your employee decided to leave, then theres bound to be a divide in the relationship you have with them, right? You may constantly be thinking, When are they going to decide to leave again? or What was it that made them decide to leave in the first place. Was it me? These are not the kind of things you want to be focusing on when it comes to one of your top employees. You want to know that they are devoted to this job and to your company. If they already decided to leave once, how do you know they wont up and leave again? One Good Reason to Counter OfferEven though counter offers are a terrible mistake, there is one good reason to make one to buy yourself some time. Perhaps you really cant afford to lose this employee right now. Maybe there is a huge project deadline coming up and losing this employee would mean not making the deadline. In the geschftliches miteinander world, this just isnt acceptable. In this case, making an offer so your empl oyee stays on for the time being may be the best option. However, you should seriously start scouring the market for a replacement pronto. As stated earlier, this counter offer is likely just a band-aid and it should be assumed that this employee will be out in six months to a year. When they do decide to leave, at least you will be fully prepared.SOURCE Dennis Wolf BlogIMAGE Courtesy of Open View Partners
